Human Rights Day: our responsibility and accountability

Menseregtedag gee erkenning aan ons pynlike verlede en 'n belofte van hoop en optimisme vir 'n land wat stewig in veelrassigheid, multikulturalisme, godsdienspluralisme, nie-seksisme en 'n absolute respek vir menseregte geanker is. Dit dien as 'n herinnering dat daar 'n tyd was toe sommige Suid-Afrikaners permitte nodig gehad het om van hulle dorpies na stede te beweeg, om te werk, eiendom te besit, goedere en dienste te koop en romantiese verhoudings aan te knoop.

Op 21 Maart 1960 in Sharpeville het sommige mense wat deel was van 'n vreedsame betoging/opmars teen hierdie permitte en paswette hulle lewens verloor en ander is gewond toe polisie op die betogers losgebrand het. Die Sharpeville-slagting het plaasgevind 20 jaar nadat die Verenigde Nasies die Universele Verklaring van Menseregte aanvaar het, wat universele menseregte erken het wat op menslikheid, vryheid, geregtigheid en vrede gegrond is. Dit is as gevolg van die gebeure van 21 Maart 1960 en ander gebeurtenisse deur die jare regoor ons land dat ons Grondwet die Handves van Regte bevat, wat menswaardigheid, gelykheid en vryheid waarborg.

Ons gedenk dus Menseregtedag om oor ons verlede na te dink en om die regte te vier wat ons as Suid-Afrikaners vandag geniet. As die lede van die breër gemeenskap van die NWU moet ons ons menseregtekultuur en demokratiese waardes elke dag demonstreer. Ons moet ook weet dat ons menseregte binne 'n raamwerk van verantwoordelikheid en aanspreeklikheid uitgeoefen moet word. Dit beteken dat wanneer studente of personeel oor 'n diens of 'n bepaalde kwessie ongelukkig of ontvrede is, hulle ook die regte van ander studente en personeel moet erken en in ag moet neem. Daarbenewens moet ons almal daarna streef om vir menseregte op te kom. Een van die groot seuns van ons land, biskop Desmond Tutu, het eenmaal gesê dat "As jy neutraal bly in situasies waar daar ongeregtigheid is, jy die kant van die onderdrukker gekies het. Indien die olifant sy voet op die stert van die muis het, en jy sê dat jy neutraal is, gaan die muis nie jou neutraliteit waardeer nie."

Kom ons laat ons stemme hoor wanneer ons onreg sien, en hande vat om menseregte te bevorder.

Die NWU se verbintenis tot 'n kultuur van menseregte is ingebed in ons strategieverklaring – om die NWU te transformeer en te posisioneer as 'n unitêre instelling van voortreflike akademiese uitnemendheid en 'n verbintenis tot maatskaplike geregtigheid. Die tema van hierdie jaar se Menseregtemaand is #LeaveNoOneBehind – walk your rights. Dit vra van ons om inklusiewe strategieë en praktyke regoor al die gebiede van ons bedrywighede te aanvaar. Die NWU se sleutelbelanghebbers, insluitende ons personeel en studente, is tans by ons strategiehersieningsprojek – Neem die NWU Vorentoe – betrokke. Ons het vooruitbetalings gemaak vir FTEN-studente wat nog steeds vir NSFAS-befondsing wag en het bykomende fondse beskikbaar gestel om akademies-verdienstelike studente te help om te registreer. Ons het die registrasietydperk verleng en gereël dat fakulteite spesiale reëlings tref om studente met voorlopige registrasie in ag te neem. Ons doen dit alles om te verseker dat almal so ver as moontlik ingesluit word, en dat niemand agterbly nie.

Ons het op 10 Maart 2023 'n memorandum van verstandhouding (MvV) met die Suid-Afrikaanse Menseregtekommissie onderteken. Hierdie vennootskap sal ons in staat stel om ons pogings te versterk om die kultuur van menseregte by die NWU en die omliggende gemeenskappe te bevorder. Die vennootskap behels 'n ondersoek na en implementering van 'n verskeidenheid kwessies, insluitende kapasiteitsbou, navorsing, beleidsformulering, die deel van inligting en bevorderingsprogramme. Ons sien daarna uit om hierdie MvV onmiddellik te implementeer om die bevordering van 'n kultuur van menseregte in ons studente- en personeelomgewing uit te bou. Hierdie vennootskap sal ons voorneme om gevalle van geslagsgebaseerde geweld en alle vorms van diskriminasie en uitsluiting, wat 'n oortreding van fundamentele menseregte is, te elimineer.

As NWU-familie en as Suid-Afrikaners moet ons altyd onthou waar ons vandaan kom en ons voorneem om nooit ooit dieselfde oortredings te herhaal nie. Vergun my asseblief om julle aan die aanhef tot ons Grondwet te herinner:

Ons, die mense van Suid-Afrika,
Erken die ongeregtighede van ons verlede;
Huldig diegene wat vir geregtigheid en vryheid in ons land gely het;
Respekteer diegene wat hul beywer het om ons land op te bou en te ontwikkel; en
Glo dat Suid-Afrika behoort aan almal wat daarin woon, verenig in ons verskeidenheid.
Daarom neem ons, deur ons vryverkose verteenwoordigers, hierdie Grondwet aan as die hoogste reg van die Republiek ten einde –

    • Die verdeeldheid van die verlede te heel en 'n samelewing gegrond op demokratiese waardes, maatskaplike geregtigheid en basiese menseregte te skep;
    • Die grondslag te lê vir 'n demokratiese en oop samelewing waarin regering gegrondves is op die wil van die bevolking en elke burger gelyk deur die reg beskerm word;
    • Die lewensgehalte van alle burgers te verhoog en die potensiaal van elke mens te ontsluit; en
    • 'n Verenigde en demokratiese Suid-Afrika te bou wat sy regmatige plek as 'n soewereine staat in die gemeenskap van nasies kan inneem.

Human Rights Day acknowledges our painful past and a promise of hope and optimism for a country firmly anchored in multiracialism, multiculturalism, religious pluralism, non-sexism and an absolute respect for human rights. It serves as a reminder that there was a time when some South Africans needed permits to move from villages to the cities, permits to work, own property, buy goods and services and to enter into romantic relationships.

On 21 March 1960, in Sharpeville, some people who were part of a peaceful protest/march against these permits and pass laws lost their lives and others were wounded when police fired at the protesters. The Sharpeville massacre took place 20 years after the United Nations had adopted the Universal Declaration of Human Rights, which established universal human rights based on humanity, freedom, justice and peace. It is because of the events of 21 March 1960 and other events that happened over the years across our country that our Constitution contains the Bill of Rights, which guarantees human dignity, equality and freedom.

Therefore, we commemorate Human Rights Day to reflect on our past and to celebrate the rights that we as South Africans enjoy today. As the members of the broader NWU community, we must demonstrate our human rights culture and democratic values daily. We must also know that our human rights are exercised within a framework of responsibility and accountability. This means that, whenever students or staff are unhappy about or dissatisfied with a service or a particular issue, they must also acknowledge and respect the rights of other students and staff. In addition, all of us must strive to be champions of human rights. One of the great sons of our country, Bishop Desmond Tutu, once remarked that "If you are neutral in situations of injustice, you have chosen the side of the oppressor. If an elephant has its foot on the tail of a mouse, and you say that you are neutral, the mouse will not appreciate your neutrality."

Let us make our voices heard whenever we witness an injustice and join hands in promoting human rights.

The NWU's commitment towards a culture of human rights is embedded in our strategy statement – to transform and position the NWU as a unitary institution of superior academic excellence, with a commitment to social justice. The theme of this year's Human Rights Month is #LeaveNoOneBehind – walk your rights. This calls for us to adopt inclusive strategies and practices across all areas of our operations. The NWU's key stakeholders, including staff and students, are currently involved in our strategy review project – Taking the NWU Forward. We have made advance payment for FTEN students who are still waiting for NSFAS funding and have made additional funds available to assist academically deserving students to register. We have extended the registration period and arranged for faculties to make special arrangements to cater for students with provisional registration. We are doing all this to ensure that, as far as possible, everyone is included, and no one is left behind.

On 10 March 2023 we signed a memorandum of understanding (MoU) with the South African Human Rights Commission. This partnership will enable us to strengthen our efforts to promote the culture of human rights in the NWU and in the surrounding communities. The partnership involves exploration and the implementation of a range of issues, including capacity building, research, policy formulation, information sharing and advocacy programmes. We look forward to the immediate implementation of this MoU to enhance the promotion of a culture of human rights in our student and staff environments. This partnership will strengthen our resolve to eliminate incidents of gender-based violence and all forms of discrimination and exclusion that are a violation of fundamental human rights.

As the NWU family and South Africans, we must always remember where we come from and make a commitment to never ever repeat the same violations. Please allow me to remind you of the preamble to our Constitution:

We, the people of South Africa,
Recognise the injustices of our past;
Honour those who suffered for justice and freedom in our land;
Respect those who have worked to build and develop our country; and
Believe that South Africa belongs to all who live in it, united in our diversity.
We therefore, through our freely elected representatives, adopt this Constitution as the supreme law of the Republic so as to –

    • Heal the divisions of the past and establish a society based on democratic values, social justice and fundamental human rights;
    • Lay the foundations for a democratic and open society in which government is based on the will of the people and every citizen is equally protected by law;
    • Improve the quality of life of all citizens and free the potential of each person; and
    • Build a united and democratic South Africa able to take its rightful place as a sovereign state in the family of nations.
